1. Definitions
In these Terms and Conditions, the following terms have the meanings given below:
- "Agreement" โ these Terms and Conditions, together with any written scope of service accepted by both parties
- "Service" โ the property rental advisory services provided by harbotn, including Lease Negotiation Assistance, Executive Relocation Support, and Neighbourhood Immersion Guide
- "Client" / "You" โ any individual or organisation that engages harbotn's services
- "We" / "Us" / "harbotn" โ harbotn, registered at 46 Jalan Raja Dr Nazrin Shah, 30250 Ipoh, Perak, Malaysia
- "Third Party" โ any landlord, property agent, school, or other external party we interact with on the client's behalf
2. Acceptance of Terms
By contacting harbotn to enquire about or commission our services, you confirm that you have read and understood these Terms and Conditions and agree to be bound by them. Use of our website constitutes acceptance of these Terms in relation to website use.
Our services are available to individuals aged 18 and over who have the legal capacity to enter into binding agreements under Malaysian law.
3. Description of Services
harbotn provides advisory and facilitation services to individuals and organisations navigating the residential property rental market in Malaysia. Our services are advisory in nature โ we do not act as licensed estate agents and we do not guarantee any particular outcome from our work on your behalf.
The three core services are Lease Negotiation Assistance (RM 1,800), Executive Relocation Support (RM 3,900), and Neighbourhood Immersion Guide (RM 6,650). The scope of each service is described on our website and confirmed in writing before engagement commences.
4. Engagement Process
All service engagements begin with an initial conversation and the agreement of a written scope document. No work is undertaken, and no fees become due, until the scope has been agreed in writing by both parties. Commencement of service delivery constitutes final acceptance of the agreed scope.
5. Client Responsibilities
To allow us to deliver our services effectively, clients agree to:
- Provide accurate and complete information relevant to the service engagement
- Respond to requests for feedback or approval within a reasonable timeframe
- Not approach landlords or agents directly on matters being handled by harbotn without notifying us first
- Use the services and any materials provided by harbotn for personal, non-commercial purposes only
6. Acceptable Use of the Website
When using our website, you agree not to engage in conduct that is unlawful, misleading, or harmful. You must not attempt to access parts of the website for which you do not have permission, introduce malicious code, or use the website to transmit unsolicited communications.
7. Payment Terms
Service fees are payable in Malaysian Ringgit (MYR) as agreed in the scope document. Payment is typically due in two instalments โ 50% upon engagement commencement and 50% upon completion โ unless otherwise agreed in writing. Accepted payment methods will be confirmed at the time of engagement.
8. Cancellation and Refunds
If you wish to cancel a service after commencement, please notify us in writing. Fees paid for work already completed are non-refundable. For work not yet undertaken at the point of cancellation, we will assess whether a partial refund is appropriate, taking into account reasonable administrative costs. Cancellations prior to commencement of work will receive a full refund.
9. Intellectual Property
All written materials produced by harbotn in the course of service delivery โ including lease annotations, neighbourhood profiles, and relocation guidance documents โ are provided for your personal use as a client. You may not reproduce, share, or commercially use these materials without our prior written consent. All intellectual property rights in harbotn's website content remain with harbotn.
10. Disclaimers
Our services are advisory in nature. We do not provide legal, financial, or real estate agency services. Nothing we produce should be treated as a substitute for qualified legal or financial advice in relation to specific circumstances. We make no representations about the conduct of landlords, agents, or other third parties, and accept no responsibility for their actions or decisions.
Outcomes from lease negotiations depend on the willingness of the landlord and cannot be warranted or predicted in advance.
11. Limitation of Liability
To the extent permitted by Malaysian law, harbotn's total liability to you in connection with any service engagement shall not exceed the total fees paid by you for that engagement. We exclude liability for indirect, consequential, or incidental losses. Nothing in these Terms limits our liability for fraud, personal injury caused by our negligence, or any other liability that cannot be excluded by law.
12. Confidentiality
We treat all client information as confidential. We will not disclose your personal or financial details to any third party without your consent, except where required to deliver the agreed service or where required by Malaysian law. Our full privacy practices are set out in our Privacy Policy.
13. Termination
Either party may terminate a service engagement by written notice. harbotn may terminate an engagement if a client provides materially false information, behaves in an abusive or threatening manner toward our team, or fails to meet agreed payment obligations. Upon termination, fees for work completed remain payable and materials prepared to that point will be delivered to the client.
14. Governing Law and Dispute Resolution
These Terms and any engagement with harbotn are governed by the laws of Malaysia. In the event of any dispute arising from these Terms or a service engagement, the parties agree to attempt informal resolution in the first instance. If this is not possible, the matter will be referred to the courts of Malaysia.
15. Entire Agreement
These Terms, together with any written scope document agreed for a specific engagement, constitute the entire agreement between the parties and supersede all prior representations or understandings. If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full effect.
16. Changes to These Terms
We may update these Terms from time to time. The revised version will be published on our website with the updated "Last Updated" date. Continued use of our services after any change constitutes acceptance of the revised Terms.
